By accessing this website, you (“Recipient”) are agreeing to be bound by the Terms of Service (“Terms”). If you do not agree with any of the Terms, you are prohibited from using or accessing this website and the services offered by Entrepreneurs’ Camps of America, LLC (“ECA”).

CONTENT

ECA provides content (“Content”) available to a recipient’s immediate family. Dissemination of any Content to anyone outside the Recipient’s immediate family is prohibited. Content is intended for people at least 13 years of age or older. Content includes any and all information provided by ECA.

WARRANTIES

ECA makes no warranties of any kind. ECA does not warranty any content, opinions, suggestions, or otherwise from itself and any agent associated with ECA, including but not limited to speakers, material from speakers, employees, entities associated with ECA, and any Content provided. ECA is not responsible for the cancellation of any events, and the change of the time or location of any events. Content and all services provided by ECA are provided “as is”, without warranty of any kind. ECA is not responsible for the Recipient receiving Content, including, but not limited to the ability to access Content.

CONDUCT AND RESPONSIBILITY

Recipient and any immediate family member(s) who Recipient identifies as accessing Content (“Student”) shall agree to conduct themselves in a respectful, responsible and harmonious manner, or access to Content may be immediately revoked without warning, and without refund or reimbursement in any way. Any environment used to deliver Content is expected to be free from distraction and unharmonious behavior. Recipient agrees to assume the responsibility of the Student, including but not limited to all personal needs, transportation, medical needs, after program supervision needs, and any food needs. Recipient and Student agree to not attend any camps available by ECA that would conflict with regularly scheduled school times.

CHANGES AND REFUNDS

All fees paid to ECA are refundable by sending an email notice at least 90 days prior to the first day of the camp session paid for at the time of checkout (“Session”); using an email sent from the Recipient’s email address (“Recipient Email”) used to pay ECA for the service, the word “Refund” in the subject line. ECA may allow Recipient to change the Student designated to receive Content at least 7 days prior to the first day of the Session beginning, so long as the individual agrees to the Terms; and the request is made by sending an email from Recipient Email that includes the word “Change” in the subject line.

RELEASE OF CLAIMS AND INDEMNIFICATION

To the maximum extent permitted by law, Recipient (for yourself, your heirs, dependents, personal representatives, assigns, and anyone else who might make a claim on your behalf), hereby release ECA and our sponsors, affiliates and contractors, and our/their respective directors, officers, employees, contractors, representatives, agents, successors, and assigns, from any and all claims, demands, causes of action, suits, damages, losses, debts, liabilities, costs and expenses (including without limitation attorneys’ fees and costs) that Recipient may have now or in the future associated with ECA and any event associated with ECA. You agree to indemnify ECA from any and all claims, demands, causes of action, suits, damages, losses debts, liabilities, costs and expenses (including without limitation attorneys’ fees and costs) brought against ECA.

LIMITATION OF LIABILITY

Recipient agrees to hold ECA and any entity associated with ECA free from any and all liability of any kind. ECA and our affiliates, sponsors and contractors, and our/their respective directors, officers, employees, contractors, representatives, agents, successors, and assigns, and any entity associated with ECA will not be liable to you under any cause of action or theory of liability, even if a party has been advised of the possibility of damages under such cause of action or theory of liability, for indirect, incidental, special, consequential or exemplary (punitive) damages. No damages related to ECA shall ever exceed the total amount they paid to ECA.

NONTRANSFERABLE

Recipient agrees any and all agreements with ECA are nonexclusive. Recipient agrees any and all agreements with ECA are nontransferable, unless explicitly stated in these Terms.

INTELLECTUAL PROPERTY

Recipient and Student agree that they have no rights to any Content created by ECA, and any agent associated with ECA. Recipient and Student agree ECA owns all rights to trademarks, copyrights or other intellectual property registered with the United States Patent and Trademark Office (USPTO). Recipient and Student agree not to record, copy, reproduce, edit, and repackage Content in whole or part without the express written consent of ECA.

WAIVER

Any failure by ECA to enforce any provision of these Terms does not constitute a present or future waiver of such provision nor limit our rights to enforce such provision at a later time. All waivers by ECA must be in writing to be effective.

ENTIRE AGREEMENT AND GOVERNING LAW

The laws of the State of Delaware, without reference to conflict of law rules, govern these Terms and any dispute of any sort that might arise between the parties. These Terms consist of the entire agreement regarding access to services provided by ECA. These Terms supersede all other understandings, agreements, or communications between with ECA, whether written or verbal, regarding services provided by ECA. Recipient and Student agree to not assist in any group legal efforts, and class action efforts against ECA. Recipient, Student, and any entity with an interest in the Terms agrees that the maximum damages shall not collectively exceed the amount they paid to ECA. Recipient, Student, and any entity with an interest in the Terms agree that any dispute and claim related to ECA must use arbitration under the laws of Delaware, as the sole form of legal dispute or claim resolution. If any part of the Terms are deemed invalid or unenforceable, then all remaining terms shall remain in force.

MODIFICATIONS OF TERMS

ECA may revise the Terms at any time without notice. Recipient and any entity engaging with ECA agree to be bound by the then current version of the Terms.

PRIVACY POLICY

ECA respects your privacy. Any and all entities associated with the ECA are expected to adhere to all governing laws, and follow the Terms as stated herein.

Information from electronic cookies are used only for routine processing of information only.
